These Terms & Conditions apply to bookings and participation in CARAOKE experiences provided by The Feel Good Family (“CARAOKE”, “we”, “us” or “our”).
By confirming a booking, paying a deposit or fee, or engaging CARAOKE to provide services, the customer agrees to these Terms & Conditions.
1. The CARAOKE Experience
CARAOKE provides mobile karaoke, music, entertainment, audience participation and related event experiences.
The exact format, duration, equipment, presenters, song availability and activities may vary depending on the booking, venue, audience, weather, technical requirements and event circumstances.
2. Customer and Venue Responsibilities
The person or organisation making the booking is responsible for ensuring that:
- CARAOKE has permission to operate at the nominated venue;
- appropriate access, space, power and other agreed facilities are available;
- the venue is suitable and reasonably safe;
- required venue approvals, permits and permissions are in place;
- guests comply with venue rules and lawful directions;
- children are appropriately supervised; and
- CARAOKE is informed in advance of material restrictions that could affect the performance.
CARAOKE must comply with reasonable venue, event, security and safety requirements.
Where venue rules, licensing conditions or lawful directions prevent an activity from occurring, CARAOKE may modify or discontinue that activity.
3. Alcohol and Intoxication
CARAOKE does not sell or supply alcohol unless expressly agreed and legally authorised to do so.
Where CARAOKE operates at licensed premises, responsibility for the sale, supply and service of alcohol, Responsible Service of Alcohol requirements and compliance with liquor licensing laws remains with the venue, licensee and their authorised staff.
CARAOKE reserves the right to refuse participation, microphone access or interaction with any person who appears intoxicated, disorderly, aggressive, abusive, unsafe or otherwise likely to create a risk to themselves, other guests, CARAOKE personnel, equipment or the venue.
A person may also be removed from the CARAOKE performance area at the request of venue management, security personnel or CARAOKE personnel.
No refund or reduction in the booking fee will be payable because an individual guest has been refused participation for safety, behavioural, licensing or venue-related reasons.
4. Guest Behaviour
CARAOKE is intended to be a fun, inclusive and family-friendly entertainment experience.
Abusive, threatening, discriminatory, sexually inappropriate, violent, dangerous or deliberately disruptive behaviour will not be tolerated.
CARAOKE may pause or stop an event where we reasonably believe continuing would place people, equipment or property at risk.
The customer is responsible for the conduct of their guests and invitees and for reasonable damage to CARAOKE equipment or property caused deliberately, recklessly or negligently by the customer or their guests.
5. Children and Minors
Children participating in CARAOKE remain under the responsibility and supervision of their parent, guardian, responsible adult, venue or event organiser as applicable.
CARAOKE does not provide child-minding or supervision services.
Participation by minors may also be subject to venue rules, licensing requirements and event conditions.
6. Song Selection and Content
CARAOKE uses third-party karaoke and music services and therefore cannot guarantee that every requested song will be available.
Songs may contain lyrics or themes unsuitable for some audiences. CARAOKE may decline particular songs or performances where we reasonably consider them inappropriate for the venue, event, audience or family-friendly nature of the experience.
Venue or event restrictions may also override song requests.
7. Photography and Filming
Photography, audio recording and video filming may occur during CARAOKE events.
Photographs and video captured by or on behalf of CARAOKE may be used to document and promote CARAOKE and The Feel Good Family through websites, social media, advertising, promotional videos and other marketing or editorial material.
Guests may therefore appear incidentally in photographs, video or audio captured during an event and subsequently published online.
The person or organisation booking CARAOKE is responsible for informing their invited guests that photography and filming may occur.
Guests who do not wish to be deliberately featured in CARAOKE promotional material should notify CARAOKE or the event organiser where reasonably practicable.
Separate or additional permission may be sought where CARAOKE intends to make an identifiable individual, particularly a child, a primary subject of promotional content.
8. Venue and Event Restrictions
CARAOKE’s operation is subject to venue rules, event conditions, liquor licensing requirements, noise restrictions, curfews, security requirements and lawful directions from venue management, event organisers or authorities.
CARAOKE is not responsible for limitations to the performance caused by restrictions imposed by the venue or event organiser where those restrictions were outside CARAOKE’s reasonable control or were not disclosed before the booking.
9. Equipment and Safety
Guests must follow reasonable instructions given by CARAOKE personnel regarding microphones, speakers, screens, electrical equipment, staging and performance areas.
Guests must not interfere with, move, climb on, damage or improperly operate CARAOKE equipment.
CARAOKE may immediately restrict access to equipment where necessary for safety or equipment protection.
10. Technical Issues
Live entertainment involves electronic equipment, software, internet connectivity and third-party services.
While CARAOKE takes reasonable steps to provide a reliable service, temporary technical interruptions may occur.
Where reasonably possible, CARAOKE will attempt to rectify technical issues or adapt the experience so the event can continue.
11. Outdoor Events and Weather
For outdoor events, the customer must provide a suitable environment for the safe operation of electronic equipment.
CARAOKE may delay, modify, relocate, suspend or cease a performance where rain, lightning, wind, extreme heat or other conditions create an unreasonable safety risk to people or equipment.
12. Booking Changes and Cancellation
Any booking-specific deposit, payment, cancellation, postponement and rescheduling conditions provided in a CARAOKE quote or booking confirmation form part of these Terms.
Changes to dates, times or venues are subject to availability.
Where circumstances outside either party’s reasonable control prevent an event proceeding, both parties will act reasonably in attempting to reschedule or reach another appropriate outcome.
13. Liability
CARAOKE will provide its services with reasonable care and skill.
To the maximum extent permitted by law, CARAOKE is not responsible for loss, injury or damage resulting from:
- the actions or behaviour of guests or other third parties;
- intoxication or alcohol consumption;
- failure by a venue, organiser or customer to comply with applicable laws or licensing requirements;
- undisclosed venue restrictions;
- unauthorised interference with CARAOKE equipment;
- circumstances outside CARAOKE’s reasonable control; or
- a customer’s failure to follow reasonable safety instructions.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
14. Damage to Equipment
The customer may be required to reimburse CARAOKE for reasonable repair or replacement costs where CARAOKE equipment is damaged by the deliberate, reckless or negligent conduct of the customer or their guests.
Normal wear and tear and equipment failure not caused by the customer or guests remain CARAOKE’s responsibility.
15. Third-Party Services
CARAOKE may rely on third-party services including karaoke software, music platforms, internet services and venue infrastructure.
Availability of particular songs, content or functionality may therefore change without notice.
16. Intellectual Property
The CARAOKE name, branding, logos, graphics, website content, promotional material and original content remain the intellectual property of their respective owners and may not be reproduced commercially without permission.
Music and karaoke content remains subject to the rights and licensing arrangements of the relevant copyright owners, licensors and service providers.
17. Governing Law
These Terms are governed by the laws of Queensland, Australia.
Where CARAOKE operates in another Australian state or territory, applicable local laws and regulations will also apply.
18. Changes to These Terms
CARAOKE may update these Terms from time to time.
The Terms applying to a confirmed booking will ordinarily be those provided or published at the time the booking is confirmed, unless a change is required by law or agreed between the parties.
